IMPORTANT: THESE TERMS CONTAIN A BINDING INDIVIDUAL ARBITRATION AGREEMENT, A CLASS-ACTION WAIVER, A JURY-TRIAL WAIVER, LIMITATIONS OF LIABILITY, AND A TIME LIMIT FOR ASSERTING CERTAIN CLAIMS. PLEASE REVIEW SECTION 15 CAREFULLY.
These Website Terms of Service (“Terms”) are an agreement between you and My Pest Pros, LLC, doing business as My Pest Pros (“My Pest Pros,” “we,” “us,” or “our”).
These Terms govern your access to and use of mypestpros.com and any related webpage, online form, customer portal, digital resource, or online service that links to these Terms, collectively referred to as the “Website.”
By accessing or using the Website, you acknowledge that you have read and agree to these Terms. If you do not agree, do not use the Website.
1. Eligibility and Authority
You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Website to enter into a transaction or agreement.
If you use the Website on behalf of a company, property owner, landlord, association, or other organization, you represent that you are authorized to act on its behalf and bind it to these Terms.
2. Website Terms Versus Pest-Control Service Agreements
These Terms govern the Website. They do not, by themselves, constitute a pest-control service agreement or guarantee that service will be available.
Quotes, scheduling requests, advertisements, website descriptions, and form submissions are subject to confirmation.
Pest-control services may be governed by a separate written agreement addressing matters such as:
- scope and frequency of service;
- property access;
- preparation requirements;
- pesticide applications;
- pricing and payment;
- cancellation or renewal;
- warranties and guarantees;
- customer responsibilities; and
- dispute resolution.
If these Terms conflict with a signed service agreement concerning the actual provision of pest-control services, the signed service agreement will control for that issue.
Submitting a website form does not guarantee an appointment, establish a final price, or create a service contract unless and until My Pest Pros confirms the appointment or accepts the service request.
3. Limited Permission to Use the Website
Subject to these Terms, My Pest Pros grants you a limited, revocable, nonexclusive, nontransferable, and nonsublicensable permission to access and use the Website for personal or legitimate business purposes.
This permission does not transfer ownership of any Website content, software, design, trademark, photograph, video, database, or other material.
We reserve all rights not expressly granted.
4. Prohibited Conduct
You may not:
- use the Website for unlawful, fraudulent, deceptive, abusive, or harmful purposes;
- submit false, misleading, impersonated, or fraudulent quote or appointment requests;
- interfere with the Website’s operation, security, servers, networks, or forms;
- attempt to bypass access controls, consent tools, rate limits, CAPTCHA, or security measures;
- introduce malware, harmful code, automated attacks, or excessive requests;
- probe, scan, or test vulnerabilities without written authorization;
- scrape, harvest, copy, index, or extract Website content or personal information through automated means except as permitted by law or authorized in writing;
- use bots, spiders, crawlers, or automated tools in a manner that burdens the Website or violates posted instructions;
- reverse engineer, decompile, or attempt to derive source code from Website technology;
- collect or process another person’s personal information without authorization;
- use Website content to train or develop an artificial-intelligence model without written permission;
- misrepresent your affiliation with My Pest Pros;
- infringe intellectual-property, privacy, publicity, contractual, or other rights;
- submit defamatory, threatening, obscene, discriminatory, or unlawful content;
- use Website information to send spam or unsolicited communications; or
- assist another person in doing any of the above.
We may suspend, restrict, or terminate access when we reasonably believe these Terms have been violated.
5. Website Information and Pest-Control Content
Website content is provided for general informational purposes.
Pest identification, treatment descriptions, seasonal information, preparation instructions, product descriptions, safety information, and blog content may not apply to every property, pest, infestation, person, pet, or situation.
Website information is not a substitute for:
- an on-site inspection;
- a written service recommendation;
- a pesticide label;
- product safety documentation;
- advice from an appropriately licensed technician; or
- emergency medical, veterinary, structural, environmental, or legal advice.
Always follow applicable product labels, preparation instructions, safety instructions, and technician directions.
If you believe a person or animal has been exposed to a potentially harmful substance, contact an appropriate emergency, poison-control, medical, or veterinary provider rather than relying on the Website.
6. Quotes, Scheduling, and Availability
Website quotes and promotional offers may be subject to:
- inspection;
- service-area limitations;
- property size and condition;
- pest type and severity;
- access requirements;
- treatment limitations;
- availability;
- taxes and additional services; and
- separate written terms.
Appointment dates submitted through the Website are requests unless expressly confirmed.
We may decline, reschedule, or cancel a request where reasonably necessary, including when information is inaccurate, a property is outside the service area, conditions are unsafe, or requested work is outside our licensing or capabilities.
7. Promotions, Coupons, and Guarantees
Promotions, discounts, coupons, warranties, and satisfaction guarantees may be subject to separate eligibility requirements, expiration dates, exclusions, service-plan requirements, and written conditions.
Unless expressly stated otherwise:
- offers cannot be combined;
- offers have no cash value;
- offers may be modified or withdrawn before acceptance;
- service guarantees apply only to qualifying services or plans; and
- guarantees do not eliminate customer preparation, access, sanitation, structural, payment, or other responsibilities.
The specific written terms accompanying an offer or guarantee control over a general Website description.
8. Electronic Communications and Signatures
By communicating with us electronically, you consent to receive records and communications electronically where permitted by law.
Electronic actions, selections, acknowledgments, and signatures may have the same legal effect as paper records and handwritten signatures where applicable law permits.
You are responsible for providing accurate contact information and updating it when it changes.
9. Text-Message Terms
When you provide a mobile number and expressly agree to receive text messages, My Pest Pros may send appointment, service, account, customer-support, review-request, or promotional messages.
Consent to receive promotional texts is not a condition of purchasing services.
Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for assistance.
Carriers are not responsible for delayed or undelivered messages.
You represent that:
- you are the subscriber or customary user of the number provided;
- you are authorized to consent to messages at that number; and
- you will notify us if the number is reassigned or no longer belongs to you.
We may use service providers to deliver messages. Mobile numbers and SMS consent records will not be sold, rented, or disclosed to third parties for their own unrelated marketing.
10. User Content, Reviews, and Feedback
You may be able to submit reviews, testimonials, photographs, messages, suggestions, feedback, or other content.
You retain any ownership rights you have in that content. By submitting it, you grant My Pest Pros a nonexclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, adapt, and publish the content for operating, improving, documenting, and promoting our business, subject to applicable law and our Privacy Statement.
You represent that:
- the content is accurate based on your honest experience;
- you have the right to submit it;
- it does not violate another person’s rights;
- it does not contain confidential information you are not authorized to disclose; and
- it is not unlawful, defamatory, fraudulent, threatening, or misleading.
We are not required to publish or retain submitted content. We may remove content that violates these Terms or applicable law.
Feedback and suggestions may be used without compensation or an obligation to implement them.
11. Intellectual Property
The Website and its contents—including text, branding, logos, graphics, photographs, videos, software, layouts, and design elements—are owned by or licensed to My Pest Pros and are protected by applicable intellectual-property laws.
“My Pest Pros” and related names, logos, slogans, and branding may be trademarks or service marks. No license to use them is granted except as necessary to access the Website in accordance with these Terms.
You may not copy, reproduce, modify, distribute, republish, publicly display, sell, license, or create derivative works from Website content without written authorization, except where applicable law expressly permits.
12. Third-Party Services and Links
The Website may contain links to or integrations with third-party services, including:
- customer-account portals;
- payment processors;
- scheduling systems;
- maps;
- reviews;
- videos;
- social-media platforms;
- advertising services;
- CAPTCHA or security services; and
- other websites or applications.
Third-party services are governed by their own terms and policies. We do not control and are not responsible for their content, availability, privacy practices, security, representations, or conduct.
A link or integration does not necessarily mean that My Pest Pros endorses or is affiliated with the third party.
13. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
MY PEST PROS DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES RELATING TO THE WEBSITE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.
We do not warrant that:
- the Website will be uninterrupted, timely, secure, or error-free;
- Website information will always be complete, current, or accurate;
- defects will be corrected;
- the Website will be free from viruses or harmful components;
- a form submission will be received or result in service; or
- Website content will meet your particular needs.
Some jurisdictions do not permit certain warranty exclusions. Those exclusions apply only to the extent permitted by law.
Nothing in this section modifies an express written warranty contained in a separate pest-control service agreement.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY PEST PROS AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO THE WEBSITE OR THESE TERMS.
This includes loss of profits, revenue, goodwill, use, data, business opportunity, or other intangible losses, even if the possibility of those damages was disclosed.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- ONE HUNDRED UNITED STATES DOLLARS ($100); OR
- THE AMOUNT YOU PAID DIRECTLY TO MY PEST PROS, IF ANY, SPECIFICALLY FOR ACCESS TO THE WEBSITE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limitations do not apply to liability that cannot legally be limited or excluded.
Claims directly concerning pest-control work performed under a separate signed service agreement are governed by that agreement to the extent applicable.
15. Dispute Resolution, Arbitration, and Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Informal Dispute Resolution
Before filing a lawsuit or arbitration, the party asserting a dispute must provide the other party with written notice describing:
- the claimant’s name and contact information;
- the facts supporting the dispute;
- the legal claims being asserted;
- the requested relief; and
- sufficient information to evaluate the claim.

Subject: “Notice of Dispute”
The parties will attempt in good faith to resolve the dispute for at least 60 days after a complete notice is received.
Completion of this informal process is a condition that must be satisfied before either party begins arbitration, except where immediate injunctive relief is reasonably necessary to prevent imminent harm.
Agreement to Individual Arbitration
Except for the exceptions stated below, any dispute, claim, or controversy arising from or relating to:
- the Website;
- these Terms;
- our Privacy Statement or Cookie Statement;
- electronic communications;
- advertising or marketing;
- the relationship between you and My Pest Pros; or
- the validity, interpretation, scope, or enforceability of this arbitration agreement
will be resolved through final and binding individual arbitration administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules and Mediation Procedures.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
The arbitrator may award the same individual remedies that would be available in court, subject to these Terms and applicable law. Judgment on the award may be entered in a court with jurisdiction.
Arbitration may be conducted by documents, telephone, video conference, or an in-person hearing as allowed by the applicable rules and determined by the arbitrator.
Fees will be allocated under the applicable AAA consumer rules, subject to applicable law.
Exceptions
Either party may:
- bring an eligible individual claim in small-claims court;
- seek temporary or preliminary relief from a court to protect intellectual-property rights, confidential information, or prevent unauthorized access or security threats; or
- pursue a remedy that applicable law expressly prohibits from being subject to arbitration.
No Class or Representative Proceedings
DISPUTES MUST BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY.
Neither you nor My Pest Pros may bring or participate in:
- a class action;
- a collective action;
- a representative action;
- a private attorney general action;
- a class arbitration; or
- a proceeding in which one person seeks relief on behalf of another person or group.
The arbitrator may not consolidate the claims of more than one person unless all parties expressly agree in writing.
If a final judicial decision determines that a particular claim or request for relief cannot lawfully be arbitrated on an individual basis, only that claim or request will proceed in court. All other arbitrable claims will remain subject to arbitration.
Jury-Trial Waiver
TO THE EXTENT A DISPUTE PROCEEDS IN COURT RATHER THAN ARBITRATION, YOU AND MY PEST PROS EACH WAIVE THE RIGHT TO A JURY TRIAL TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Arbitration Opt-Out
You may opt out of this arbitration agreement by sending a written notice within 30 days after the date you first become subject to these Terms.
The notice must include:
- your full name;
- mailing address;
- email address;
- telephone number;
- the date you first used the Website after these Terms became effective;
- a clear statement that you wish to opt out of the arbitration agreement; and
- your signature.
Send the notice to the mailing and email addresses listed above with the subject line “Arbitration Opt-Out.”
Opting out of arbitration will not affect the remaining provisions of these Terms.
Time Limit for Claims
TO THE MAXIMUM EXTENT PERMITTED BY LAW, A CLAIM ARISING FROM OR RELATING TO THE WEBSITE OR THESE TERMS MUST BE FILED WITHIN ONE YEAR AFTER THE CLAIM ACCRUES. OTHERWISE, THE CLAIM IS PERMANENTLY BARRED.
Where applicable law does not permit this limitation, the shortest legally permitted limitation period will apply.
16. Governing Law and Court Venue
Except to the extent governed by the Federal Arbitration Act or preempted by federal law, these Terms are governed by the laws of the Commonwealth of Virginia, without applying conflict-of-law principles.
For any dispute permitted to proceed in court, the parties consent to exclusive jurisdiction and venue in:
- the state courts serving Fairfax County, Virginia; or
- the United States District Court for the Eastern District of Virginia,
unless applicable law requires a different venue.
17. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless My Pest Pros and its owners, affiliates, officers, employees, contractors, and representatives from third-party claims, liabilities, losses, judgments, damages, costs, and reasonable attorneys’ fees arising from:
- your unlawful or unauthorized use of the Website;
- content you submit;
- your violation of these Terms;
- your infringement of another person’s rights; or
- fraud, intentional misconduct, or misuse of Website systems attributable to you.
This section does not require indemnification for conduct caused solely by My Pest Pros where indemnification is prohibited by law.
18. Suspension and Termination
We may restrict, suspend, or terminate access to the Website at any time when reasonably necessary to:
- protect security or operations;
- investigate suspected misconduct;
- enforce these Terms;
- comply with law; or
- discontinue a Website feature.
Provisions that by their nature should survive termination will remain effective, including intellectual-property, disclaimer, liability, indemnification, and dispute-resolution provisions.
19. Changes to the Website or These Terms
We may modify, suspend, or discontinue all or part of the Website.
We may update these Terms by posting a revised version with a new “Last Updated” date. Material changes will apply prospectively from their stated effective date.
Where required by law, we will provide additional notice or request agreement to material changes.
Your continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
20. General Provisions
These Terms, together with policies and notices expressly incorporated into them, constitute the agreement concerning use of the Website.
A separate signed pest-control service agreement remains a separate agreement.
If a provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
Our failure to enforce a provision is not a waiver.
You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or similar transaction.
Nothing in these Terms creates an agency, partnership, joint venture, employment, fiduciary, or franchise relationship.
These Terms do not create rights for third-party beneficiaries.
Headings are for convenience and do not affect interpretation.
